The new Massachusetts laws on Domestic Assault and battery provide for harsh consequences. If you are charged with domestic assault it would be very prudent for you to consult with an experienced criminal defense attorney right away. Often times a domestic arrest is the result of an argument between a couple and a call to the police which most likely results in the arrest of someone. Once an allegation of and assault, a threat to commit a battery, or and assault and battery has been made, the police in most instances are trained to arrest the alleged offending party if the allegation is credible.

Once there is an arrest the charged person cannot be released from the police station for at least six hours. The so called cooling off period. The next stage in the case is the arraignment. Arraignment issues in domestic violence charges are a critical stage in the proceedings and it is important you have experienced counsel guiding you and looking out for your interests. Individuals released at the police station are often times surprised to learn that even thought they voluntarily came to the court on their own for arraignment the district attorney is now asking for a high cash bail or moving for a dangerousness hearing.

Each case is different and requires a fact intensive analysis application to the law. Often times the caller appears in court and tells the prosecutor they want the charges dropped. The district attorney is in most cases is not going to drop the charges but instead will try to get a guilty finding or proceed to trial.

Unfortunately it is not up to the caller to drop the charges once an arrest has been made. The decision to prosecute rests alone with the district attorney. In most cases the prosecutor will zealously prosecute the case even asking for bail at the arraignment. The courts take allegations of domestic assault very seriously. If there is an allegation that hands were put on a neck or there was attempted strangulation you can almost be assured the prosecutor will move to have you held without bail for up to 120 days.
